We thank you for your generous donation to such a noble cause as digital cultural preservation. Your contribution will go towards Arc/k’s goals of capturing, education, and archiving for the future. The Arc/k Project supports non-profit organizations, citizen scientists and volunteers from around the world who seek to document their own local cultural heritage for future generations. We are dedicated to ethical practices in digital cultural heritage collection and preservation.

Donation Agreement

With the intent to submit this Work for dissemination to the general public, I agree to the following terms and conditions:

1.) In self-archiving this collection of files and associated bibliographic metadata (the Work), I grant The Arc/k Project and its agents the non-exclusive and perpetual license to publish, archive and make accessible the Work in whole or in part, in all forms of media, now or hereafter known and in all languages throughout the world.

2.) I understand that I may enter into separate, additional contractual arrangements (or Memorandum of Agreement) for the non-exclusive distribution of the Work so long as such contracts do not conflict with the Author's choice of a Creative Commons License in connection with the submission of the Work.

3.) I represent and warrant that if I am the photographer: (a) the Work is my original work; (b) I possess all right and authority to grant a non-exclusive license in the Work to The Arc/k Project; (c) I have not transferred exclusive rights in the Work to any third party; (d) the Work contains no misrepresentation or infringement of third parties' work or property; and (e) the Work contains no libel, invasion of privacy, or other unlawful matter.

4.) I represent and warrant that if I am NOT the photographer: (a) the Work is in the Public Domain or is compliant with all Creative Commons License restrictions set by the rights holder; or (b) I have permission from the rights holder to donate the Work to The Arc/k Project.

5.) I agree to promptly furnish The Arc/k Project, at the Author's own expense, written evidence of the permissions, licenses, and consents for use of third party material included within the Work upon request.

6.) I agree to indemnify and hold The Arc/k Project harmless from any breach of the representations and warranties set forth in this Agreement, as well as any claim or proceeding relating to The Arc/k Project's use and publication of any content contained in the Work, to include third party content unless specified in a contractual arrangement or Memorandum of Agreement.

7.) I acknowledge that the objects depicted in the Work are not images of human remains, funerary objects, sacred objects, or objects of cultural patrimony related to any Indigenous Community and is compliant with the principals of The Native American Graves Protection Act (1990)

8.) I represent and warrant that cultural objects depicted in the Work are

(a) not related to Illicit import, export and/or transfer of ownership of cultural property which lends to the impoverishment of the cultural heritage of the countries of origin of such property;

(b) not related to any theft from cultural heritage institutions, Indigenous communities or private collections;

(c) not acquired through the looting of archaeological sites or via the displacement of artifacts due to war.

Privacy Policy
1.INTRODUCTION

Arc/k, a California non-profit organization (“us,” “we,” or “Company” or “Organization”), is committed to respecting the privacy rights and protecting the identity of its customers, visitors, and other users of the Company Website located at www.arck-project.com (“the Site”). We understand that the choice to post Content is a personal and sensitive decision, and must be treated with deference. We therefore created this Website Privacy Policy (“Privacy Policy”) to give you confidence as you visit and use the Site, and to demonstrate our commitment to fair information practices, the protection of privacy and the decision to remain anonymous. This Privacy Policy is only applicable to the Site, but not to any other websites that you may be able to access from the Site, each of which may have data collection, storage, and use practices and policies that differ materially from our Terms of Use and this Privacy Policy.

2. INFORMATION COLLECTION PRACTICES
2.1 TYPES OF INFORMATION COLLECTED

(a) TRAFFIC DATA COLLECTED. We may track and collect the following categories of information when you visit our Site: (1) IP addresses; (2) domain servers; (3) types of computers accessing the Site; and (4) types of web browsers used to access the Site (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you but is helpful for improving your experience on the Site.

(b) PERSONAL INFORMATION COLLECTED. In the event you contribute Content, you will have the opportunity to provide the Company with certain information that personally identifies you (“Personal Information”). Personal Information includes, but is not limited to your name, email address, and information you contribute. If you communicate with us by email any information provided in such communication may be collected as Personal Information. WHEN UPLOADING CONTENT THROUGH OUR WEBSITE, YOU WILL ALWAYS HAVE THE OPTION TO REMAIN ANONYMOUS AND UPLOAD CONTENT WITHOUT PROVIDING ANY PERSONALLY IDENTIFYING INFORMATION BY SUBMITTING VIA A “DUMMY EMAIL.” HOWEVER, BY USING A DUMMY EMAIL, YOU WILL NOT RECEIVE CONFIRMATION OR NOTICE OF CONTENT EXPIRATION FROM WETRANSFER.COM.

(c) CONTENT INFORMATION COLLECTION. In the event you contribute Content, you will have the opportunity to provide the Company with certain information that identifies or otherwise describes the Content (e.g. identity, location and/or historical significance of subject matter of Content (“Content Information”). Content Information shall also include any information volunteered by you to us via email.

2.2 USES OF INFORMATION COLLECTED

(a) COMPANY USE OF PERSONAL INFORMATION. We may use Personal Information to confirm receipt of any information you have provided, contact you to provide you with any notice required under the Terms of Use or notify you with an opportunity for further collaboration. Furthermore, any information provided via Arc/k Donation Portal will be subject to being embedded as metadata to the donated images and related output created from them. Metadata associated with the images will be made available online for authenticity purposes. If you have provided us with Personal Information and either (a) would like to review or revise information that you previously provided to us, (b) no longer want us to contact you, (c) do not want your information publicly shared, or (d) do not want your information embedded as metadata to the donated images or renderings, you may email us at info@arck-project.org.

(b) SHARING OF PERSONAL INFORMATION. Except as set out in this Privacy Policy, the Company does not disclose or sell your Personal Information to any third-parties. We may, however, disclose your Personal Information to third-party service providers who perform services on our behalf, for example to the extent we hire other companies to provide data storage, to host websites, or to conduct audits, etc.; in which case, such third-party service providers (i) will be required to protect Personal Information to the same extent as the Company, and (ii) shall be prohibited from using your Personal Information.

(c) COMPANY USE OF CONTENT INFORMATION. Content Information shall be deemed “Content” within the meaning of the Terms of Use and treated accordingly.

3. SECURITY OF YOUR PERSONAL INFORMATION

The security of your Personal Information is important to us. We follow generally accepted industry standards to help protect your Personal Information including without limitation:

i. limiting access to your Personal Information to those of our employees who require it to manage your donated content;

ii. ensuring that third-party service providers sign confidentiality agreements to maintain the confidentiality of your Personal Information and not to use it for any unauthorized purposes; and

iii. storing your Personal Information in secure computer systems which protect it from unauthorized access or use.

No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to protect your Personal Information, we cannot guarantee its absolute security.

4. DATA PROTECTION RIGHTS

The Arc/k Project would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:

The Right to Access - You have the right to request The Arc/k Project for copies of your personal data. We may charge you a small fee for this service.

The Right to Rectification - You have the right to request that The Arc/k Project correct any information you believe is inaccurate. You also have the right to request Our Organization to complete information you believe is incomplete The Right to Erasure - You have the right to request that Our Organization erase your personal data, under certain conditions

The Right to Restrict Processing - You have the right to request that Our Organization restrict the processing of your personal data, under certain conditions.

The Right to Object to Processing - You have the right to object to Our Organization’s processing of your personal data, under certain conditions.

The Right to Data Portability - You have the right to request that Our Organization transfer the data that we have collected to another organization, or directly to you, under certain conditions.
